Mexico and the defense of human rights

Abstract

The historical narrative of the protection of human rights should be consistent with that of the human being, derived from the concept of humanity. This essay tries to show that this has not been the case, that the recognition and respect for these prerogatives has gone through various stages and great global events such as wars, defeats and some conquests; and that only after such events against humanity the human rights were reflected in agreements between sovereign states, called “International treaties”, concentrated in supranational international organizations and created on the occasion of the two great world conflicts in the 20th century. The text first addresses the ideas of freedom and equality proposed by pioneering philosophers in this area. Afterwards, it explains the importance of international conventions, their obligation and compliance in our legal system and that their effective application is a pending task, due to obvious areas of opportunity indicated in the sentences issued by the Inter-American Court of Human Rights against our state. Since the constitutional reform of June 2011, the legal operator interested in resolving issues related to the possible violation of human rights must seek the broadest protection in two systems of law: national and conventional.
